McDaniel Supporter’s Election Suit Thrown Out

LAUREL, Miss. – A lawsuit to stop crossover voting in Tuesday’s GOP runoff election has been dismissed by a Chancery Judge in Jones County. 

A supporter of Republican Senate candidate Chris McDaniel filed the suit in chancery court Monday.  A day later, Ronald Swindall decided not to go forward with the case and requested that it be dropped.

Under state law, only the voters who cast ballots in the Democratic primary on June 3 are prohibited from voting in the Republican runoff.  Tea party members had said another Mississippi law allowed people to vote in a party primary only if the voter intended to support the party’s nominee in the general election.  A federal appeals court ruled that law unenforceable in 2008.
